Call to End the 'Unfair Subsidy' of Insurers

APIL (the Association of Personal Injury Lawyers) has called upon the government to introduce a fund of last resort for workplace injuries, thus ending the "unfair subsidy" of insurers.
In an article for New Law Journal, APIL vice-president Karl Tonks said that the existing system of tracing insurers for cases of longtail disease, such as mesothelioma, has "failed too many people".
An employee suffering a workplace injury is left subsidising an insurance company when he cannot bring a case because it is not possible to trace his employer or his employer’s insurer.
Karl Tonks called for a fund of last resort, also known as an employers' liability insurance bureau (ELIB) to be set up and paid for by insurers as they "have been able to avoid providing proper redress for many claims over the years".
He wrote: "The Association of British Insurers (ABI) has said previously that 'insurers remain fully committed to paying fair compensation claimants as quickly as possible'. However, the insurance industry has not matched these fine words with sufficient action".
