Case previously dealt with by Trinity Law Partnership succeeds in Supreme Court
On the 2 March 2016 the Supreme Court gave Judgment in the matter of Ahmed Mohamud v Morrisons Supermarkets PLC.
Gerry O’Brien of Trinity Law Partnership acted for Mr Mohamud at the original County Court Trial.
The case is the leading authority on the issue of vicarious liability.
Mr Mohamud was assaulted by an employee of Morrison’s and the issue was whether Morrison’s were liable for the assault.
The Supreme Court found in favour of Mr Mohamud.
Whilst confirming the “close connection” test, the Supreme Court Judgement has potentially widened the scope of vicarious liability making it easier for Claimants to succeed in such cases
